• Not use Holly.ai as a substitute for emergency medical services (911 / emergency lines)
• Not use the service for any unlawful, fraudulent, or unauthorized purpose
• Comply with all applicable local, national, and international laws and regulations
• Not attempt to reverse-engineer, disassemble, or interfere with the service

05 Disclaimer of Warranties

Holly.ai is provided "as-is" and "as available" without warranties of any kind, express or implied. SHAKEapp Inc. does not warrant that the service will be uninterrupted, error-free, or meet your specific requirements.

• Holly.ai is not a substitute for emergency medical care. Always dial emergency services for life-threatening situations.
• SHAKEapp Inc. is not liable for missed appointments caused by call failures, connectivity issues, or patient error.
• SHAKEapp Inc. is not liable for call failures resulting from third-party infrastructure outages (Retell AI, Twilio, WhatsApp, etc.).

06 Limitation of Liability

To the maximum extent permitted by law, SHAKEapp Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Holly.ai, including but not limited to loss of revenue, data, or business opportunities.

07 Termination

Either party may terminate the service relationship with 30 days written notice. SHAKEapp Inc. reserves the right to suspend or terminate accounts immediately for violation of these terms, fraudulent activity, or non-payment. Upon termination, your data will be handled per our Privacy Policy.

08 Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of California, United States of America, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Nevada County, California.

04 Uso Aceptable

Holly.ai está destinado exclusivamente a clínicas médicas y proveedores de salud autorizados. Usted se compromete a:

• Usar el servicio únicamente para el agendamiento legítimo de citas médicas
• No usar Holly.ai como sustituto de los servicios de emergencias médicas (líneas de emergencia)
• No usar el servicio para ningún propósito ilegal, fraudulento o no autorizado
• Cumplir con todas las leyes y regulaciones locales, nacionales e internacionales aplicables
• No intentar realizar ingeniería inversa, desensamblar o interferir con el servicio

05 Limitación de Garantías

Holly.ai se proporciona "tal cual" y "según disponibilidad" sin garantías de ningún tipo, expresas o implícitas. SHAKEapp Inc. no garantiza que el servicio sea ininterrumpido, libre de errores o que satisfaga sus requisitos específicos.

• Holly.ai no es un sustituto de la atención médica de emergencia. Siempre llame a los servicios de emergencia ante situaciones de riesgo vital.
• SHAKEapp Inc. no es responsable por citas perdidas causadas por fallas en las llamadas, problemas de conectividad o error del paciente.
• SHAKEapp Inc. no es responsable por fallas en las llamadas debidas a interrupciones de infraestructura de terceros (Retell AI, Twilio, WhatsApp, etc.).

06 Limitación de Responsabilidad

En la máxima medida permitida por la ley, SHAKEapp Inc. no será responsable por daños indirectos, incidentales, especiales, consecuentes o punitivos derivados del uso de Holly.ai, incluyendo pérdida de ingresos, datos u oportunidades de negocio.

07 Terminación

Cualquiera de las partes puede terminar la relación de servicio con 30 días de aviso por escrito. SHAKEapp Inc. se reserva el derecho de suspender o cancelar cuentas de forma inmediata por violación de estos términos, actividad fraudulenta o falta de pago. Tras la terminación, sus datos serán tratados conforme a nuestra Política de Privacidad.

08 Ley Aplicable

Estos Términos de Servicio se regirán e interpretarán de conformidad con las leyes del Estado de California, Estados Unidos de América, sin tener en cuenta sus disposiciones sobre conflicto de leyes. Cualquier disputa se resolverá en los tribunales del Condado de Nevada, California.
